Preamble
FANZ Unlimited Network was built on a singular conviction: creators deserve total ownership of their content, their audience, and their livelihood — free from arbitrary censorship, algorithmic suppression, and platform dependency. Fans deserve authentic connection without surveillance capitalism mining their intimacy for profit.
The adult creator economy has long been treated as a second-class industry — debanked, deplatformed, and demonetized without warning, explanation, or appeal. FANZ exists to end that era.
This Constitution establishes the immovable foundation of the FANZ ecosystem. It defines what we stand for, what we owe every person who trusts us with their work, their identity, and their money — and what principles no business pressure, acquisition offer, or regulatory overreach can cause us to abandon.
We commit to this Constitution publicly, permanently, and without reservation. It is enforceable. It is not marketing.
Article I
Creator Rights & Sovereignty
§ 1.1 — Content Ownership
Creators retain 100% ownership of all content they publish on FANZ platforms. No license granted to FANZ extends beyond what is strictly required to operate, display, and distribute content as directed by the creator. FANZ will never sell, sublicense, or train AI models on creator content without explicit, revocable, separately-signed consent.
§ 1.2 — Right to Portability
Creators have an unconditional right to export their full content library, subscriber list (in anonymized aggregate), earnings history, and analytics data at any time, in machine-readable formats, within 48 hours of request — free of charge. No platform lock-in, no hostage data.
§ 1.3 — Right to Explanation
Any moderation action — content removal, account restriction, or payout hold — must be accompanied by a specific written explanation within 24 hours. Vague policy citations without contextual reasoning are not acceptable. Creators have a right to appeal every decision to a human reviewer.
§ 1.4 — Right Against Algorithmic Suppression
FANZ will not silently shadowban, throttle, or demote creator content as a penalty mechanism. Any algorithmic ranking changes that affect creator visibility must be disclosed in creator dashboards. Punitive distribution changes require the same notice and appeal rights as content removal.
§ 1.5 — Right to Identity
Creators may operate under pseudonyms and stage personas. FANZ collects legal identity only for legally mandated purposes (age verification, tax compliance, CSAM prevention). Legal names will never appear in public-facing contexts without explicit creator consent.
§ 1.6 — Right to Organized Advocacy
Creators have the right to organize, advocate for policy changes, form creator coalitions, and publicly criticize FANZ policies — without retaliation, account penalty, or preferential treatment being withheld as leverage. FANZ commits to a formal Creator Advisory Council with binding consultation rights on policy changes affecting creator economics.
Article II
Fan & Subscriber Rights
§ 2.1 — Honest Commerce
Fans will never be deceived about pricing, subscription terms, renewal dates, or cancellation procedures. All costs are displayed before purchase. Subscription renewals trigger email notification 72 hours in advance. Cancellation is always one click — never hidden behind a call-center or dark pattern.
§ 2.2 — Right to Authentic Interaction
Fans have a right to know when they are interacting with an AI system rather than a creator. AI-assisted messaging and AI-generated content must be clearly labeled. FANZ prohibits automated systems from impersonating real creators without conspicuous disclosure.
§ 2.3 — Privacy in Fandom
Fan subscription status, purchase history, and interaction data will never be disclosed to third parties, advertisers, or other creators without explicit consent. FANZ will not build or sell behavioral profiles of fans for external targeting purposes.
§ 2.4 — Right of Access & Deletion
Any fan may request a complete export of their personal data within 72 hours or request full account deletion — which permanently and irreversibly removes all personal data from FANZ systems within 30 days, subject only to legal retention obligations.
§ 2.5 — Protection from Exploitation
FANZ prohibits predatory upselling mechanics, manufactured false scarcity, and psychological manipulation techniques designed to extract money from vulnerable fans. Our monetization tools exist to connect genuine value with willing payment — not to exploit compulsion loops.
Article III
Content Principles
§ 3.1 — Freedom of Adult Expression
FANZ is an adult platform. Legal adult content created by verified consenting adults is a legitimate form of human expression, labor, and art. FANZ will not apologize for hosting it. Moralistic censorship of lawful adult content will not occur on this platform.
§ 3.2 — Absolute Prohibitions
The following are unconditional prohibitions from which no exception, creator tier, or commercial consideration grants exemption:
- • Child sexual abuse material (CSAM) in any form — including AI-generated depictions
- • Non-consensual intimate imagery (NCII) — real or synthetic
- • Content depicting real violence, torture, or degradation of non-consenting persons
- • Content that facilitates trafficking, exploitation, or coercion
- • Content that targets, harasses, or outs individuals without consent
- • Doxxing: publishing private personal information to enable harm
Violations are reported to NCMEC, law enforcement, and relevant authorities without hesitation, negotiation, or delay.
§ 3.3 — Consent as Cornerstone
Every performer appearing in content must have provided verifiable, documented consent. FANZ 2257 compliance infrastructure exists not as bureaucratic compliance theater but as a genuine mechanism for protecting performers. Creators bear responsibility for content they publish; FANZ provides the infrastructure for that accountability.
§ 3.4 — AI-Generated Content Standards
AI-generated content is permitted subject to disclosure requirements and the same absolute prohibitions as live-action content. AI cannot be used to generate synthetic sexual content depicting real, identifiable individuals without documented consent from those individuals. FANZ will maintain and publish standards for AI content as the technology evolves.
§ 3.5 — No Retroactive Censorship
Content that complied with FANZ policies at the time of publication will not be retroactively removed due to policy changes — unless it falls within the absolute prohibitions in § 3.2. Creators will receive no less than 90 days notice before a policy change affects existing published content.
Article IV
Safety & Platform Integrity
§ 4.1 — Age Verification
Every person creating or accessing explicit content on FANZ platforms must be verified as 18 years of age or older through government-issued ID verification. This is non-negotiable and absolute. Age gates are not marketing — they are barriers that protect minors and every creator on this platform.
§ 4.2 — CSAM Detection & Reporting
FANZ operates continuous CSAM scanning through industry-standard hash-matching technology (PhotoDNA) and AI detection across all uploaded media. Any detected CSAM is immediately removed, the uploading account permanently terminated, and a report filed with NCMEC's CyberTipline. There are no exceptions, appeals, or delays in this pipeline.
§ 4.3 — Harassment & Stalking Prevention
FANZ treats systematic harassment, stalking behavior, and doxxing as platform integrity violations equivalent in severity to financial fraud. We maintain dedicated tooling to detect coordinated harassment campaigns and will block, ban, and when legally appropriate refer users to law enforcement.
§ 4.4 — Transparent Moderation
FANZ publishes a quarterly Transparency Report disclosing: content removal counts by category, NCMEC reports filed, law enforcement requests received and complied with, and appeals outcomes. Moderation decisions are made by humans, not automated systems alone, for any action that affects a creator's account or revenue.
§ 4.5 — Performer Safety Resources
FANZ maintains a dedicated safety resource hub for performers, including connections to legal aid, mental health support, trafficking resources, and industry advocacy organizations. Safety is not a checkbox — it is a living obligation.
Article V
Privacy & Data Sovereignty
§ 5.1 — Data Minimization
FANZ collects only the data necessary to operate the platform, comply with legal obligations, and provide the services explicitly requested. We do not collect to monetize. We do not build behavioral profiles for sale to third parties. Every data field we collect must have a specific operational justification documented internally.
§ 5.2 — No Surveillance Advertising
FANZ's business model is subscription and creator revenue share — not advertising. We will not embed third-party ad trackers, sell behavioral data to ad networks, or participate in real-time bidding ecosystems with user data. This is structural, not aspirational — advertising revenue would require model changes that would require this Constitution's amendment process.
§ 5.3 — Identity Protection for Adult Workers
Legal identity documents collected for compliance purposes are stored in encrypted, access-controlled vaults separate from platform databases. Identity verification vendors are contractually prohibited from retaining biometric data beyond verification. Staff access to identity documents is logged, audited, and restricted to verified legal necessity.
§ 5.4 — Breach Notification
In the event of a data breach affecting personal information, FANZ commits to notifying affected users within 72 hours of discovery — before, not after, regulatory deadlines. Notification will include: what data was exposed, what we are doing to mitigate harm, and what affected persons can do to protect themselves.
§ 5.5 — Geofencing & Regional Compliance
Where regional law restricts or prohibits access to adult content, FANZ implements technical access controls rather than compromising the privacy or safety of users who access through other means. User IP data used for geo-compliance is processed in-memory and not logged to persistent storage.
Article VI
Economic Rights & Compensation
§ 6.1 — Revenue Share Transparency
FANZ publishes its revenue share rates publicly and changes to them require 90 days advance notice to affected creators. The calculation methodology for every payout must be accessible to creators in their dashboards — not just the final number, but the formula.
§ 6.2 — Payout Rights
Creators are paid on a predictable, published schedule. Payout holds are permitted only for active fraud investigations, unresolved identity verification, or chargeback resolution — and only with written notice, estimated resolution timeline, and escalation path. Funds may not be held as leverage in policy disputes.
§ 6.3 — No Retroactive Fee Changes
Platform fees earned on completed transactions are final. FANZ will not retroactively alter the revenue share on past earnings. Changes to fee structures apply prospectively only, from the effective date disclosed in advance notice to creators.
§ 6.4 — Payment Processor Independence
FANZ actively maintains relationships with multiple payment processors and financial partners to prevent a single processor's policies from becoming the de facto content policy of the platform. Creator earnings are never contingent on the approval of payment networks — FANZ accepts responsibility for compliance independent of processor politics.
§ 6.5 — Account Termination & Owed Earnings
In the event of account termination for policy violations, creators retain right to all earnings accrued prior to termination, paid out on the next standard payout cycle, minus any legitimate chargeback or fraud offsets. Earnings cannot be forfeited as penalty for policy violations unless a specific fraud finding is documented and appealable.
Article VII
Platform Governance
§ 7.1 — Creator Advisory Council
FANZ establishes a Creator Advisory Council (CAC) composed of active creators elected by the creator community. The CAC has mandatory consultation rights — meaning FANZ must present major policy changes affecting creator economics, content rules, or platform governance to the CAC and document their feedback before implementation. The CAC's recommendations are advisory; their consultation is binding process.
§ 7.2 — Policy Change Process
Material changes to this Constitution, the Terms of Service, Content Policy, or Revenue Share structure require: (1) 90-day advance notice published to all active creators, (2) CAC consultation, (3) a public comment period of no less than 30 days, (4) publication of a summary of community feedback received and FANZ's response. Emergency safety-related changes may bypass notice requirements but must be publicly ratified within 30 days.
§ 7.3 — Acquisition & Ownership Changes
In the event of an acquisition, merger, or ownership change that would result in FANZ platforms being controlled by a new entity, creators will be notified no less than 60 days in advance (where legally permitted) and will have the right to export their full content and subscriber data at no charge before the transition completes. The acquiring entity must, as a condition of acquisition, publicly affirm this Constitution or negotiate amendments through the standard process above.
§ 7.4 — Regulatory Compliance vs. Creator Rights
When legal or regulatory requirements conflict with rights established in this Constitution, FANZ commits to: (a) notifying affected creators of the legal requirement and its scope, (b) challenging regulations that unjustifiably violate creator rights through available legal channels, and (c) minimizing the scope of compliance to what is strictly legally required rather than using regulation as pretext for broader restrictions.
Article VIII
Community Standards
§ 8.1 — Dignity & Respect
FANZ is a platform where adult expression flourishes, but it is not a platform where dehumanization, slurs deployed as weapons, or targeted hate campaigns find a home. We distinguish between explicit content (welcome) and content whose primary purpose is to degrade or harm specific persons or groups on the basis of identity (not welcome).
§ 8.2 — Inclusion
FANZ is explicitly designed to serve creators and fans across every orientation, gender identity, body type, race, age (18+), and kink spectrum. Algorithmic systems are audited for discriminatory bias. FANZ will not permit its recommendation or discovery systems to systematically marginalize content based on the creator's identity.
§ 8.3 — Community Enforcement
Community members are empowered to report violations, with each report reviewed by a human moderator within 48 hours. Good-faith reporting is protected — retaliatory reports filed against creators who reported violations will be identified and result in the retaliating account's suspension.
§ 8.4 — No Brigading
Coordinated off-platform campaigns to mass-report creators, harass fans, or organize pressure targeting FANZ to remove specific creators on political or moral grounds will be treated as platform integrity attacks. FANZ will not remove lawful content in response to coordinated external pressure campaigns.
Article IX
Amendments & Evolution
§ 9.1 — Amendment Process
This Constitution is a living document. It may be amended as the platform evolves, the legal landscape shifts, and the creator community's needs change. Amendments require the full policy change process described in § 7.2. The ratification date and version number will be updated with each amendment, and a public changelog will be maintained.
§ 9.2 — Unamendable Provisions
The following provisions of this Constitution may not be amended through any process:
- • The absolute prohibitions of § 3.2 (CSAM, NCII, non-consensual content)
- • The mandatory age verification requirement of § 4.1
- • The CSAM reporting obligation of § 4.2
- • The right of creators to export their content and data (§ 1.2)
- • The right to explanation for moderation actions (§ 1.3)
These provisions represent the non-negotiable ethical floor of the platform. Any transaction, acquisition, regulatory settlement, or business arrangement that would require their removal is one FANZ will refuse.
§ 9.3 — Accountability
This Constitution is not self-enforcing through legal mechanism alone. It is a public commitment, and the most powerful enforcement mechanism is the trust of the creator community. FANZ publishes this document because we want to be held to it. If we violate it, say so. Loudly.
Declaration
We, the founders and operators of FANZ Unlimited Network LLC and FANZ Group Holdings LLC, ratify this Constitution as the governing ethical framework of every platform we operate. It supersedes marketing language, investor decks, and internal convenience. It is what we are.
